How to Cancel Your Gym Membership in Virginia

The Virginia Health Club Act (Va. Code § 59.1-296 et seq.) gives gym members a 3-business-day cooling-off period and unusually practical post-window rights: cancellation for death, for a documented inability to use the club for 30 or more consecutive days, and for club relocation or closure without comparable facilities within 5 driving miles. Cancellation must be in writing by certified mail or personal delivery, and clubs must return any promissory notes within 30 days.

Virginia lets you cancel if you're medically unable to use the gym for just 30 consecutive days, one of the shortest disability thresholds in the country, and a nurse practitioner's note is enough.

Cancel rights after cooling-off

Virginia gym members can cancel within 3 business days of signing for a full refund. After that, the Health Club Act (§ 59.1-297) allows cancellation if: (1) the member dies, (2) the member becomes physically unable to use a substantial portion of the services for 30 or more consecutive days (with a signed statement from a doctor, physician assistant, or nurse practitioner), or (3) the club relocates or closes and fails to provide comparable facilities within 5 driving miles.

Auto-renewal rule

Virginia has no gym-specific auto-renewal statute, so your contract's renewal clause governs. Deceptive renewal practices can still be challenged under the Virginia Consumer Protection Act (§ 59.1-196 et seq.), and the Health Club Act requires clubs to honor the statutory cancellation grounds regardless of renewal terms.

Virginia Gym Cancellation FAQs

How do I cancel my gym membership in Virginia?

Send written cancellation notice by certified mail, return receipt requested, to the address specified in your contract (or hand-deliver it and get a signed acknowledgment). Cite Va. Code § 59.1-297 and your qualifying ground, and attach your provider's signed statement if cancelling for a physical condition.

Can I cancel my Virginia gym membership at any time?

Within 3 business days of signing, yes. After that you need a qualifying ground: death, a 30+ consecutive-day inability to use a substantial portion of the services (doctor, PA, or APRN certified), or club relocation/closure without comparable facilities within 5 driving miles.

Do I need a lawyer to cancel my gym membership?

No. The letter plus certified mail is usually enough. If the club refuses a valid cancellation, the Virginia Office of the Attorney General's Consumer Protection Section takes complaints, and General District Court handles claims up to $25,000 without requiring a lawyer.

What if my Virginia gym refuses to accept my cancellation?

Dispute post-cancellation charges with your card issuer, file a complaint with the Virginia AG's Consumer Protection Section, and if needed sue in General District Court. The club's failure to honor § 59.1-297 also supports a Virginia Consumer Protection Act claim.
