How to Cancel Your Gym Membership in Arizona

Arizona regulates gym contracts under its health spa statutes (A.R.S. § 44-1791 et seq.). You get a 3-operating-day cooling-off window, a 3-year cap on contract length, and statutory cancellation rights for death or permanent disability, moves beyond 25 miles, and out-of-state military deployment. Unusually, the statute lists email and the club's website as valid cancellation channels, which removes the classic 'you have to come in to cancel' excuse.

Arizona is one of the few states whose gym statute lets you cancel by email or through the club's website, and deployed service members get a statutory out.

Cooling-off period

3 operating days

A.R.S. § 44-1791 et seq. (Health Spa Services)

Cancel rights after cooling-off

Arizona gym members can cancel before midnight of the third operating day after receiving a copy of the contract, for a full refund within 30 days (A.R.S. § 44-1793). After that, cancellation is allowed for: (1) death or permanent disability, (2) relocation more than 25 miles from the facility or an affiliated facility with equivalent services, or (3) active-duty military deployment outside Arizona (within 90 days of orders). Contracts cannot run longer than 3 years.

Auto-renewal rule

Arizona's health spa statute expressly allows cancellation by email or through the club's website, in addition to mail and personal delivery. On a post-window cancellation, the club may keep charges for services used plus expenses, capped at 25% of the total contract price. Deceptive renewal practices fall under the Arizona Consumer Fraud Act.

Arizona Gym Cancellation FAQs

How do I cancel my gym membership in Arizona?

Send written notice by mail, email, through the club's website cancellation option, or hand-deliver it, any method the statute or your contract allows. Cite A.R.S. § 44-1793 and your qualifying ground, attach documentation (orders, physician's statement, proof of address), and keep a copy with the date sent.

Can I cancel my Arizona gym membership at any time?

Within 3 operating days of receiving your contract, yes. After that you need a qualifying ground (death, permanent disability, 25+ mile relocation, or out-of-state deployment). On qualifying cancellations the club can retain at most services used plus expenses up to 25% of the contract price.

Do I need a lawyer to cancel my gym membership?

No. The statutory grounds are clear enough to assert yourself. If the club refuses, the Arizona Attorney General takes consumer fraud complaints online, and Justice Court handles claims up to $10,000 without a lawyer.

What if my Arizona gym refuses to accept my cancellation?

Dispute the charges with your bank or card issuer, file a complaint with the Arizona AG's Consumer Protection Section, and if needed file in Small Claims or Justice Court. A club ignoring § 44-1793 is also exposed under the Arizona Consumer Fraud Act.
