How to Cancel Your Gym Membership in New Jersey
New Jersey regulates gym contracts under the Health Club Services Act (N.J.S.A. 56:8-39 et seq.), part of the state's Consumer Fraud Act. You get a 3-operating-day cooling-off window, statutory cancellation rights for death, physician-confirmed permanent disability, and moves beyond 25 miles, and a hard 30-day deadline for the club to refund your money. Cancel rights after cooling-off
New Jersey gym members can cancel for any reason before midnight of the third operating day after receiving a copy of the contract, for a full refund within 30 days. After that, cancellation is allowed for: (1) death, (2) permanent disability fully described and confirmed to the club by a physician, or (3) relocation more than 25 miles from the club or an affiliated club with the same or similar services. The club may keep charges for services already used plus up to 10% for expenses.
Auto-renewal rule
Since a 2023 amendment to the Health Club Services Act (P.L. 2023, c. 241), New Jersey clubs that let you sign up online must also let you cancel online, and cancellation by telephone or written notice is expressly allowed for qualifying cancellations. Cancellation-by-friction (in-person-only cancellation for an online signup) violates the Consumer Fraud Act.
