Texas Privacy Rights Request
Texas's Data Privacy and Security Act (TDPSA, Tex. Bus. & Com. Code § 541.001 et seq., effective July 1, 2024) grants Texas consumers rights to access, delete, correct, and opt out of personal data processing. Unlike some state privacy laws, the TDPSA has no minimum revenue threshold, any business (except small businesses as defined by the SBA) that processes personal data of Texas consumers must comply. The Texas AG has exclusive enforcement authority with penalties up to $7,500 per violation.

What rights do Texas consumers have under the TDPSA?▾
Access, delete, correct, data portability, and opt out of targeted advertising / sale of personal data / profiling for significant decisions. Sensitive data (health, biometric, children's data, precise geolocation) requires explicit consent. Controllers must respond within 45 days.
Which businesses must comply with the Texas TDPSA?▾
Any business (except SBA-defined small businesses) that processes personal data of Texas consumers or produces products/services targeted to Texas consumers. Unlike CCPA, there is no minimum revenue threshold, the reach is very broad.
How do I make a TDPSA request?▾
Submit a verifiable consumer request through the business's designated channel. A formal letter citing Tex. Bus. & Com. Code § 541.051 and specifying your right is always valid. If the business fails to respond within 45 days, file a complaint with the Texas AG (txk12.org/privacy or ag.texas.gov).
