New York Credit Report Error Dispute

New York consumers have the federal FCRA and New York's own Fair Credit Reporting Act (N.Y. Gen. Bus. Law § 380 et seq.), which imposes obligations on credit bureaus and furnishers beyond the federal law. The New York AG has taken action against major credit bureaus for systemic failure to resolve consumer disputes, making New York one of the most active states for credit reporting enforcement.

New York's state FCRA (GBL § 380) imposes additional obligations on credit reporting agencies and provides a private right of action, the NY AG has actively enforced it against Equifax and Experian.

New York Credit Dispute FAQs

Does New York's state FCRA add any extra protections?

Yes. N.Y. Gen. Bus. Law § 380-j requires credit reporting agencies to reinvestigate disputed information within 30 days and maintain procedures to prevent recurrence of deleted errors. The NY state law also provides a private right of action for violations.

What do I include in a credit dispute letter?

Your full name, address, Social Security number (last 4 digits for security), the specific item in dispute (account name, number, date), a clear statement of what is wrong, supporting documentation (payment records, identity theft police report, etc.), and a request for investigation and correction or deletion.

How long do negative items stay on my New York credit report?

Under both the federal FCRA and N.Y. GBL § 380-j: 7 years for most negative items (late payments, collections, charge-offs); 10 years for bankruptcies. If an item is older than these limits and still appearing, it must be removed upon dispute.
