Ohio Child Medical Consent Form
Ohio Revised Code Section 3109.52 lets a parent, guardian or custodian grant a grandparent a power of attorney that includes authority to consent to medical, psychological or dental treatment for the child. The section is deliberately bounded. It does not hand over legal custody, it cannot grant authority to consent to the child's marriage or adoption, and it does not affect the parent's, guardian's or custodian's rights in any future custody proceeding. For grandparent caregiving arrangements, which Ohio sees a great many of, it is the statute a provider will expect you to be working from.
Ohio's grandparent power of attorney under Section 3109.52 expressly reaches consent to medical, psychological and dental treatment, but it does not transfer legal custody.

Can an Ohio grandparent consent to medical treatment for a grandchild?▾

Does the Ohio power of attorney give the grandparent custody?▾
No. Section 3109.52 does not grant legal custody, and it does not affect the rights of the parent, guardian or custodian in any future proceeding concerning custody. It is a delegation of specific authority, not a change in who the child's legal custodian is.
What can the Ohio power of attorney not cover?▾
It may not grant authority to consent to the marriage or adoption of the child. Those are excluded by statute regardless of how the document is worded.
