Gym Cancellation Laws Are Changing State by State in 2026 (And Why You Still Need Proof)
Three states passed new gym and subscription cancellation laws that took effect at the start of 2026, and New York City just sent compliance warnings to nearly 200 gyms over so-called subscription traps. But a new law making cancellation easier on paper does not stop a gym from claiming it never got your request, which is still the actual problem behind most billing disputes.
New York: cancel within 3 days, refund within 10 business days
New York's new gym and subscription cancellation law took effect February 1, 2026. It requires businesses to let customers cancel a contract without penalty up to three days after signing, and it requires businesses to accept cancellation requests and issue refunds within ten business days of being notified.
That second part is the one that matters if you've already been a member for a while and want out. The law puts a hard clock on the gym: once you notify them, they have ten business days to process it and refund what they owe. A gym that lets that window pass without acting is no longer just being slow, it is out of compliance with state law.
Maine and Connecticut added their own rules for 2026
Maine's "An Act to Protect Maine Consumers by Simplifying Subscription and Health Club Membership Cancellations" applies to subscriptions entered into or renewed on or after January 1, 2026. The core rule: if a gym lets you sign up online, it has to let you cancel online too. No more sign-up-in-two-clicks, cancel-only-in-person setups.
Connecticut's new law takes a different angle: once you cancel, the gym is required to give you written confirmation of that cancellation within 10 days. That confirmation is exactly the kind of paper trail that ends a "we never received your cancellation" dispute before it starts, assuming the gym actually sends it.
NYC's compliance blitz: 187 gyms warned in one month
In February 2026, New York City's Department of Consumer and Worker Protection, under Mayor Zohran Mamdani, sent citywide compliance warnings to nearly 200 gyms and health clubs, including major chains like Planet Fitness, Equinox, and PureGym, over what the city is calling "subscription trap" practices.
This matters beyond New York because it signals where enforcement attention is heading nationally. Gyms that have relied on friction, in-person-only cancellation, buried cancellation flows, ignored written requests, are now squarely in regulators' sights in multiple states at once, not just at the federal level.
None of this replaces proof of delivery
Here's the part these new laws don't fix: a law that requires a gym to accept your cancellation within 10 days only works if the gym agrees it received your request in the first place. Every one of these new state laws still depends on you being able to prove, with a date, that you actually sent your cancellation.
